These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age and accept delivery. Flakyscalp.com reserve the right to change or discontinue any of the products available at any time.
Each order or request for goods shall be an offer by you to purchase the goods subject to these terms and conditions. Once we have received payment of the whole of the price for the goods, your order can be accepted. Our acceptance of your order brings into existence a legal binding contract between us (“the Contract”). Once we have received payment an email will be sent to you, at the email address you provide with your order, to confirm that your order has been received and what goods will be supplied.
The prices payable for goods that you order are as set out in our website. The prices quoted on this website are in UK Pounds Sterling and include VAT at the rate of 17.5%. Outside the UK your credit card company will charge you in your local currency at the exchange rate at that time. Both payments and refunds are in UK Pounds Sterling and we will not be responsible for any loss due to fluctuations of exchange rates where applicable.
We accept major credit and debit cards including Visa, Mastercard, Electron, Delta, Solo and Switch. On the order you must provide us with your exact billing address and telephone number - the address and phone number that your credit card or debit card bank has on file for you. Incorrect information will cause a delay in processing your order and we will not be responsible for any such delay. Your order will only be processed once authorisation of your credit or debit card has been properly received.
Your credit card company may carry out security checks to confirm that your order is a genuine one. Orders are subject to our own security and credit card verification procedures. Flakyscalp.com reserves the right to withhold any order that has failed to be verified. Should there be any problem with verification of your card details you will be notified by email.
UK customers may also pay by cheque. Cheques should be made payable to Flakyscalp.com. A copy of the order, your contact details and delivery address should be sent with the cheque to our contact address. Please note that we cannot dispatch the goods until payment has been cleared and this can take at least 10 days.
You will be required to pay extra for delivery and it might not be possible for us to deliver to some locations, in such circumstances we reserve the right to cancel the Contract and return your payment to you, as detailed in the condition below. A minimum £3.95 postage and packaging will be added to all orders in the UK unless stated otherwise.
You may cancel the Contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods. To cancel the Contract you must notify us in writing at our contact address. You do not need to give us any reason for cancelling the Contract nor will you have to pay any penalty.
You cannot cancel the Contract if the seal on the goods you have ordered has been broken or the goods have been opened or, in the case of perishable goods, used.
If you have received the goods before you cancel the Contract then, unless you have lost your right to cancel the Contract under this condition, you must send the goods back to our contact address at your own cost and risk. If you cancel the Contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address, at your own cost and risk as soon as possible.
Once you have notified us that you are cancelling the Contract, any sum debited to us from your debit or credit card will be re-debited or re-credited to your account, and any cheque cancelled, as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-debited or re-credited to you.
We reserve the right to cancel the Contract if:
We have insufficient stock to deliver the goods that you have ordered;
The goods you have ordered have been discontinued;
We do not deliver to your area;
One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers; or
We consider it reasonable to do so.
If we do cancel the Contract we will notify you by email and will re-debit to your account any sum deducted by us from your debit or credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
We will deliver the goods ordered by you under the Contract to the address you give us for delivery at the time you make the order within a reasonable period of time, although time shall not be of the essence in respect of delivery.
You will become the owner of the goods you have ordered as soon as we have received payment from you. Once we have received payment for the goods they will be held at your own risk and you will therefore be responsible for their loss or destruction in transit and for insuring the goods in that respect unless otherwise expressly agreed in writing.
If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing, at our contact address, within 10 working days of the delivery of the goods in question.
If you notify us under this condition we will investigate the circumstances and if in our reasonable opinion you have not received the correct goods in the right condition we will either:

If any part of these terms and conditions is found to be unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms and conditions will not be affected. Any terms and conditions found to be unenforceable will to that extent be severed from the remaining terms and conditions will continue to be valid and enforceable to the fullest extent permitted by law.
